1. General
Ahmad Shikhani, owner of the sole proprietorship JoyPlus, Josef-Weinheber-Straße 8A, 5204 Straßwalchen, Austria, offers private scenic tours with chauffeur-driven vehicles in Austria and neighboring countries under the brand “JoyPlus.” Bookings can be made via the website, by phone, email, or WhatsApp.
JoyPlus is not a travel agency and exclusively offers transport services (passenger transportation) with licensed vehicles in accordance with Austrian trade regulations. Tours are conducted solely as scenic round trips without guided tours or entrance arrangements. Admission fees, food & beverages, guided services or third-party services are not included and must be arranged and paid by the customer independently.
2. Contractual Relationship and Booking
A binding contract between JoyPlus and the customer is concluded upon booking via the website, email, telephone, or WhatsApp. Bookings via WhatsApp are also considered legally binding.
Tours are carried out either by JoyPlus or by carefully selected partner companies using vehicles licensed by local authorities. In all cases, JoyPlus remains the direct contractual partner of the customer.
3. Scope of Service
The booked service includes a private scenic round trip according to the description on the website or as individually agreed.
Not included:
- Admission fees (e.g. for museums, cable cars, spas, etc.)
- Food & beverage services or restaurant reservations
- Guided tours or externally organized activities
JoyPlus is not permitted to offer or broker such services. The customer is solely responsible for arranging and paying for these services.
4. Prices and Payment
All prices are total rates per tour and vehicle, including VAT.
Payment is due at the time of booking via online payment methods (e.g. credit card, PayPal, Apple Pay, Klarna, Google Pay).
In the event of refunds, up to 5% in processing fees may be deducted if such fees were incurred through external payment providers.
5. Cancellation and Refund Policy
- Free cancellation: up to 24 hours before the scheduled tour
- 50% refund: for cancellations 12–24 hours before the tour
- No refund: for cancellations less than 12 hours before the tour or no-shows
Cancellations must be made in writing via email, telephone, or WhatsApp.
Weather conditions: If a tour cannot be carried out due to severe weather (e.g. road closures, storm warnings), both parties may cancel without penalty. In this case, refunds will be issued after consultation with JoyPlus.
6. Conduct During the Tour
Passengers must comply with all applicable traffic and safety regulations during the ride. Wearing a seatbelt is mandatory.
Smoking, consuming food, or bringing animals without prior approval is prohibited. Alcohol may only be consumed with prior permission.
The customer is liable for any excessive soiling or damage to the vehicle caused by them or their companions. JoyPlus assumes no liability for forgotten or lost personal belongings.
7. Changes After the Tour Begins
Requests for changes during the tour (e.g. extended stops or added destinations) can only be accommodated if time and driving conditions allow. Additional services will be charged separately based on the extra effort required.
Shortening the tour at the customer’s request will not result in a price reduction.
8. Liability
JoyPlus is only liable for damages caused intentionally or through gross negligence. JoyPlus accepts no liability for the performance or failure of services provided by third-party providers (e.g. boat operators, museums, cable cars).
No liability is assumed for delays, changes to the itinerary, or cancellations caused by weather, traffic, or force majeure.
9. Governing Law and Jurisdiction
The legal relationship between JoyPlus and the customer is subject exclusively to Austrian law.
The exclusive place of jurisdiction – where legally permitted – is the competent court in 5202 Neumarkt am Wallersee, Austria.
10. Final Provisions
JoyPlus reserves the right to amend these T&C at any time without prior notice. The version valid at the time of booking shall apply.
Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
